Legal experts say that when a court writes in its verdict that the offender has to hand himself over to the authorities, he cannot file an appeal without doing so.
Former president of the Supreme Court Bar Association, Kamran Murtaza, told The News that it is correct for the Supreme Court registrar to return Musharraf's appeal because the special court has ruled that the culprit must first hand himself over to the authorities.current world news
He said that if the court did not write such a decision in his judgment, he could have filed an appeal without arrest.
He further said that usually in criminal cases, courts are allowed to file an appeal even after a certain amount of time, as this case is between the court and the offender.
He said that the then Prime Minister Nawaz Sharif was allowed by the Supreme Court to file an appeal after 9 years. He also said that in civil cases courts are very strict over time because they have a public rights issue.
Leading lawyer Barrister Omar Sajjad said that courts usually emphasize the need to arrest the culprit in order to file an appeal. He once said that there was an opportunity to convict the political leader in his absence. Went and granted the right to appeal against this decision in his absence.
He said that in the Nawaz Sharif case, the Islamabad High Court accepted his appeal and inquired that he had given his arrest after conviction and it was stated that his request was granted. The arrest of the former prime minister was confirmed and he was in Adiala jail.
The special court, in its judgment, directed law enforcement agencies to make every effort to arrest the culprit and ensure that the punishment was done according to the law.
On Friday, the Supreme Court Registrar rejected Pervez Musharraf's request and objected to the Supreme Court's rules that the culprit must be arrested before applying for the offender.
The former dictator's lawyer must re-appeal within 30 days of the registrar's decision. Only after the approval of it will the decision of the Lahore High Court in which the decision of the special court and the establishment was declared unconstitutional.
